РЕШЕНИЕ ПРОБЛЕМ КОНСТИТУЦИОННОГО ХАРАКТЕРА,
ПРЕДЛОЖЕННОЕ ФРАНЦИЕЙ

Конституционный совет Французской Республики рассмотрел вопрос о том, не содержатся ли в Римском статуте положения, противоречащие конституции страны. В своем постановлении от 22 января 1999 г. (Cons. Constitutionnel, 22 janvier 1999, Traite portant statut de la Cour penale internationale, 98-408 DC, http://www.conseil-constitutionnel.fr/decision/1998/98408/
984098dv.htm), Совет дал положительный ответ на этот вопрос и указал на существование трех проблем:
1) Отказ в иммунитете главам государства, предусмотренный в статье 27 Статута, противоречит трем статьям Конституции Французской Республики:

Статьи 26, 68 и 68-1 Конституции гласят:

Статья 26

Ни один член Парламента не может подвергаться преследованиям, быть объявлен в розыск, арестован, задержан или предстать перед судом за высказанные им в результате голосования или иным способом мнения в период исполнения своих служебных обязанностей. Любой член парламента может быть арестован или подвергнут любой другой форме лишения или ограничения свободы по делу о совершении уголовного преступления или проступка только с разрешени
