The Government of the Russian Federation and the Government of the Republic of Turkey, hereinafter referred to as "the Parties",
Desiring to further develop cooperative, mutually beneficial and friendly relationship between the Russian Federation and the Republic of Turkey,
Recognizing the importance of international cooperation to ensure safe use of nuclear energy for peaceful purposes,
Aware of the necessity to prevent nuclear accidents and to minimize their transboundary consequences,
Mindful that the Russian Federation and the Republic of Turkey are Parties to the Convention on Early Notification of a Nuclear Accident dated 26th of September 1986, hereinafter referred to as "the Convention", as well as to the Convention for Nuclear Safety dated 17th of June 1994, and
Aiming at establishing a legal framework to exchange information on nuclear facilities and early notification of accidents which may result in transboundary release of radioactive materials and to enhance cooperation for improving nuclear and radiological safety;
have agreed, as follows:
Article 1
Scope of application
1. The provisions of this Agreement related to the notification of nuclear accidents and exchange of information shall apply to the facilities and activities referred to in Article 1 of the Convention, as well as to the events mentioned in Article 2, Paragraph 2 and 3 of this Agreement.
2. The provisions of this Agreement related to the exchange of information about nuclear facilities shall apply to the facilities defined by the Parties. The list of nuclear facilities which is the subject of information exchange shall be defined jointly by the Competent Authorities stated in Article 5, Paragraph 1 of the Agreement in the course of development of measures to implement the obligations resulting from the Agreement. The list of nuclear facilities shall be updated in case of construction of new nuclear facility or facilities.
Article 2
Notification of nuclear accidents
1. In case of any accident involving facilities or activities of either Party or of persons or legal entities under jurisdiction or control of the State of the Party, as stated in Article 1, Paragraph 1 of the Convention, from which a release of radioactive material occurs or may occur and which has resulted or may result in a transboundary release that could be of radiological safety significance for the State of other Party, the Party on the territory of its jurisdiction on which the accident took place, shall make an earliest possible notification to the other Party, and shall promptly submit all information available in accordance with Article 5 of the Convention.
2. The Parties shall promptly inform each other on any other accidents, other than those mentioned in Paragraph 1 of this Article, occurred on the territory of their States and may be the source of transboundary release of radioactive materials significance for the other Party in terms of radiological safety.
3. In case the radioactive monitoring system of either Party records an increasing of radiation level on its respective state territory, significant for the other Party in terms of radiological safety, which was not caused by release from facilities or activities on its state territory, this Party shall promptly notify the event to the other Party and shall continue to keep the other Party informed as the situation develops.
Article 3
Exchange of information
1. The Parties shall provide each not less than once a year or upon request the information so that the Parties could make an assessment and own analyses of possible impact of nuclear facilities stated in Article 1, par
