Republic of Turkey of 6 December 2004 and the Joint Declaration on Progress towards a New Stage in Relations and Further Deepening of Friendship and Multifaceted Partnership between the Russian Federation and the Republic of Turkey of 13 February 2009,
Based on the Treaty on the Principles of Relations between the Russian Federation and the Republic of Turkey of 25 May 1992,
In order to enhance the efficiency of cooperation in the domain of peaceful use of nuclear power based on the Agreement between the Government of the Russian Federation and the Government of the Republic of Turkey on cooperation in the area of energy dated 15 December 1997,
Agreed as follows;
Article 1
The Parties in the framework of this cooperation welcome the signing of the Agreement between the Government of the Russian Federation and the Government of the Republic of Turkey on "Cooperation in the Peaceful Uses of Nuclear Energy" and the Agreement between the Government of the Russian Federation and the Government of the Republic of Turkey on "Early Notification of Nuclear Accidents and Exchange of Information on Nuclear Facilities".
Article 2
Upon the completion of necessary legal procedures, provided that the ongoing tender process for Akkuyu NPP is finalized, the Parties shall provide the necessary assistance for the implementation of the Project for the construction of the first Nuclear Power Plant (NPP) in Turkey and shall make necessary efforts to provide for the conditions of Project implementation.
Article 3
Following the suggestion of Russian-Turkish Consortium, Turkish Government will consider entering the share capital of the NPP at the rate of %25 +1 stock and granting of a preferential purpose tied loan for crediting the whole scope of civil and erection works, and supply of equipment performed by Turkish organizations/companies in order to decrease the cost of the electricity produced at the plant.
Article 4
The Parties will establish a bilateral working group to examine the possibilities in a comprehensive manner of the realization of future joint projects for the peaceful uses of nuclear energy in Russia, Turkey and third countries.
Article 5
Disputes and differences between the parties with regard to interpretation and/or application of provisions of the given Protocol shall be resolved through negotiations between the Parties.
Article 6
This Protocol shall enter into force upon signature.
Done in Ankara this 6th day of August 2009 in two copies, each in the Russian, Turkish and English languages, all texts being equally authentic. In case controversies should arise regarding the interpretation of this Protocol, the text in English shall be used.
