<а> Весь плутоний, за исключением плутония, изотопная концентрация которого превышает 80% по плутонию-238.
<б> Ядерный материал, не облученный в реакторе, или ядерный материал, облученный в реакторе, но с уровнем облучения, равным или менее 1 Гр/ч (100 рад/ч) на расстоянии одного метра без защиты.
<в> Количество, не подпадающее под категорию III, а также природный уран, обедненный уран и торий следует защищать, по крайней мере, исходя из соображений практической целесообразности.
<г> Хотя рекомендуется данный уровень защиты, Стороны могут, исходя из оценки конкретных обстоятельств, определить другую категорию физической защиты.
<д> Другое топливо, которое до облучения входило, в зависимости от первоначального состава делящегося материала, в категорию I или II, может быть понижено по уровню не более чем на одну категорию, если уровень излучения топлива превышает 1 Гр/ч (100 рад/ч) на расстоянии одного метра без защиты.
AGREEMENT
BETWEEN THE GOVERNMENT OF THE RUSSIAN FEDERATION AND
THE GOVERNMENT OF JAPAN FOR COOPERATION IN THE PEACEFUL
USES OF NUCLEAR ENERGY
(Tokyo, 12.V.2009)
The Government of the Russian Federation and the Government of Japan (hereinafter referred to as "the Parties");
Desiring to strengthen the friendly relations existing between the Russian Federation and Japan;
Being convinced that expanding cooperation between the Russian Federation and Japan in the peaceful uses of nuclear energy will contribute to the furtherance of friendship and mutual understanding;
Desiring to continue to cooperate in the development of the peaceful uses of nuclear energy;
Considering the close cooperation between the Russian Federation and Japan in the peaceful uses of nuclear energy under the Agreement between the Government of the Union of Soviet Socialist Republics and the Government of Japan for Cooperation in the Field of the Peaceful Uses of Nuclear Energy, done on April 18, 1991 (hereinafter referred to as "the Agreement of 1991");
Mindful that both the Russian Federation and Japan are parties to the Treaty on the Non-Proliferation of Nuclear Weapons, done on July 1, 1968 (hereinafter referred to as "the Non-Proliferation Treaty");
Recognizing that both the Russian Federation and Japan are members of the International Atomic Energy Agency;
Recognizing also the advantages to both countries of effective cooperation in the development of the peaceful uses of nuclear energy; and
Desiring to establish conditions consistent with their commitment to nuclear non-proliferation under which cooperation in the peaceful uses of nuclear energy between the Russian Federation and Japan can be carried out;
Have agreed as follows:
Article 1
For the purposes of this Agreement:
(1) "Authorized person" means
in the case of the Russian Federation, any legal entity within the jurisdiction of the Russian Federation and authorized by the Government of the Russian Federation, and, in the case of Japan, any individual or entity within the jurisdiction of Japan and authorized by the Government of Japan, to cooperate under this Agreement, including to supply or receive nuclear material, material, equipment and technology, and
